  • New Fraud & Integrity Offence Laws: The bill introduces strict criminal and civil penalties to stamp out NDIS fraud, including bans on provider kickbacks, misleading information, and record destruction.
  • Refined Eligibility & Parental Expectations: The legislation clarifies expected parental care levels when determining support, allows prospective participants to receive other compensation while awaiting access decisions, and provides clearer guidelines on debt recovery transparency.

Rollout Timeline

Immediate (Next Week) - Budget reassessments will only be granted for "significant and ongoing" changes. Participants must now retain service records for 3 years.

October 2026 - The 50% funding cut for social and community participation takes effect during plan renewals. The Thriving Kids program rolls out to support children under 9 with mild-to-moderate autism or developmental delay outside the NDIS.

January 2028 - Introduction of a new functional capacity test to determine scheme eligibility, projected to transition roughly 241,000 participants off the NDIS by 2031.
